At the beginning of a marriage, everything is great, and the newly married couple cannot even fathom that there is a possibility of divorce. This is however not the situation in many marriages with scientists saying that the greater part of married couples separates after a while. The reasons behind this very with everyone having their own opinion why married couples no longer stay married. With this information in mind, every married couple should plan for a divorce beforehand and how they will handle their divorce in case it happens. This should be done whether they see it coming or not because no one can tell what the future holds. Before getting married, the two gatherings should get ready for each possible result and be prepared for it so that they are not totally at a misfortune if something occurs. Having everything planned in advance will also facilitate the procedure for the couple because they won’t be moving into odd territory.
It is very difficult to find a marriage where both parties are at the same level financially, most of the time, one spouse gets more money than the other. This could be due to many reasons, maybe one has a higher paying job, or maybe one decided to stay at home and take care of the house while the other worked. With this in mind, the laws of some states state that all the money that was earned during a marriage should be split in half when the couple wants a divorce. This means the couple will have to present their documents for the court to view. All the money that was made by all of them since the day they got married and any asset they bought during that time is put into consideration by the court. All this will be summed up and then split fairly regardless of whether it was just one partner that was working or one partner earned more than the other. Also, if the judge sees that one partner needs financial support, he or she could make the other spouse give their ex a monthly allowance. This monthly allowance has a name, and that is alimony, which is known in some places as spousal support. The person being offered support can choose to take it or to decline it.
The court allows someone to waive their spousal support as long as it is clear that it is their decision and has not been forced unto them by anyone. They should post the waiver in writing with both parties putting their signature on it. In the waiver, they should also put a rundown of the property that they own. This is so that the court can see that the party that is petitioning for a waiver will not remain totally helpless. The waiver is only acknowledged if the judge is persuaded that everybody included will be alright after the procedure is completed.
